{"id":1430,"date":"2022-03-01T16:07:48","date_gmt":"2022-03-01T16:07:48","guid":{"rendered":"https:\/\/digmit.at\/?page_id=1430"},"modified":"2024-01-02T14:46:54","modified_gmt":"2024-01-02T14:46:54","slug":"ich-bin-drittstaatsangehoriger-und-betroffener-von-gewalt-menschenhandel-frauenhandel","status":"publish","type":"page","link":"https:\/\/digmit.at\/index.php\/startseite\/aufenthaltsrecht\/ich-mochte-in-osterreich-leben-und-oder-arbeiten\/ich-bin-drittstaatsangehoriger-und\/ich-bin-drittstaatsangehoriger-und-betroffener-von-gewalt-menschenhandel-frauenhandel\/","title":{"rendered":"Ich bin Betroffene*r von Gewalt \/ Menschenhandel \/ Frauenhandel."},"content":{"rendered":"\n<p>Wenn ich als <strong>Drittstaatsangeh\u00f6rige*r<\/strong> <strong>von Gewalt, Menschenhandel oder Frauenhandel betroffen<\/strong> bin, kann ich beim <strong><a href=\"https:\/\/www.bfa.gv.at\"><\/a><strong><a href=\"https:\/\/www.bfa.gv.at\">Bundesamt f\u00fcr Fremdenwesen und Asyl (BFA)<\/a><\/strong><\/strong> eine <strong>Aufenthaltsberechtigung nach Paragraph 57 AsylG<\/strong> beantragen.<\/p>\n\n\n\n<p>Um diese Aufenthaltsberechtigung zu bekommen, <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>muss ich <strong>als \u201eOpfer\u201c oder\/und Zeug*in<\/strong> von Menschenhandel oder grenz\u00fcberschreitendem Prostitutionshandel in einem laufenden <strong>Strafverfahren oder Zivilverfahren<\/strong> sein,<\/li>\n\n\n\n<li>und es darf <strong>keine Erteilungshindernisse<\/strong> geben (zum Beispiel Aufenthaltsverbot).<\/li>\n<\/ul>\n\n\n\n<p>Die Aufenthaltsberechtigung gilt mindestens f\u00fcr <strong>1 Jahr<\/strong> oder solange das Strafverfahren oder Zivilverfahren noch offen ist.<\/p>\n\n\n\n<p>Mit einer Aufenthaltsberechtigung darf ich arbeiten. <br>Ich brauche aber eine <strong>Besch\u00e4ftigungsbewilligung vom <a href=\"https:\/\/www.ams.at\/arbeitsuchende\">AMS<\/a><\/strong>. Die Besch\u00e4ftigungsbewilligung beantragt mein*e Arbeitgeber*in beim AMS.<\/p>\n\n\n\n<p><br><br>Nach einem Jahr kann ich beim <strong><a href=\"https:\/\/www.bfa.gv.at\">BFA<\/a><\/strong> eine <strong>Verl\u00e4ngerung der Aufenthaltsberechtigung gem\u00e4\u00df Paragraph 59 AsylG<\/strong> beantragen. <\/p>\n\n\n\n<p>Ich brauche weiterhin ein laufendes&nbsp;<strong>Strafverfahren oder Zivilverfahren<\/strong>, und es darf <strong>keine Erteilungshindernisse<\/strong> geben.<\/p>\n\n\n\n<p>Dann bekomme ich die <strong>Aufenthaltsberechtigung nach Paragraph 59<\/strong> f\u00fcr <strong>1<\/strong> weiteres <strong>Jahr<\/strong>.<\/p>\n\n\n\n<p><br>Wenn ich neben dem laufenden <strong>Strafverfahren oder Zivilverfahren<\/strong> auch noch<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Deutsch<\/strong>kenntnisse auf <strong>A2<\/strong>-Niveau (<strong><a href=\"https:\/\/digmit.at\/index.php\/ich-muss-fur-meinen-aufenthalt-eine-deutschprufung-machen\/#moduleins\">Modul 1 Integrationsvereinbarung<\/a><\/strong>), <\/li>\n\n\n\n<li><strong>finanzielle Mittel<\/strong> (zum Beispiel regelm\u00e4\u00dfiges Einkommen),<\/li>\n\n\n\n<li>eine <strong>Unterkunft<\/strong> (Mietvertrag oder Wohnrechtsvertrag) und<\/li>\n\n\n\n<li>eine <strong>Krankenversicherung<\/strong> habe, <\/li>\n\n\n\n<li>und wenn es <strong>keine Erteilungshindernisse<\/strong> gibt (zum Beispiel Aufenthaltsverbot), <\/li>\n<\/ul>\n\n\n\n<p>bekomme ich von der <a href=\"https:\/\/www.wien.gv.at\/kontakte\/ma35\/\">MA 35<\/a> eine <strong>Rot-Wei\u00df-Rot Karte plus<\/strong>.<\/p>\n\n\n\n<p>ACHTUNG<br>Den <strong>Antrag<\/strong> muss ich <strong>beim <a href=\"https:\/\/www.bfa.gv.at\">BFA<\/a> stellen<\/strong> und <strong>nicht bei der MA 35!<\/strong><\/p>\n\n\n\n<p>Mit einer Rot Wei\u00df Rot Karte plus <strong>darf<\/strong> ich in \u00d6sterreich <strong>arbeiten<\/strong>. <br>Ich brauche keine Besch\u00e4ftigungsbewilligung mehr.<\/p>\n\n\n\n<p>Wenn ich die <strong>Rot-Wei\u00df-Rot Karte plus verl\u00e4ngern<\/strong> will, brauche ich <strong>kein<\/strong> laufendes <strong>Strafverfahren oder Zivilverfahren<\/strong> mehr.<\/p>\n\n\n\n<p><br><br>Wenn ich <strong>humanit\u00e4ren\/s Aufenthalt\/Bleiberecht nach Paragraph 55<\/strong> habe, darf ich mit einer <strong>Besch\u00e4ftigungsbewilligung vom <a href=\"https:\/\/www.ams.at\/arbeitsuchende\">AMS<\/a><\/strong> arbeiten. <\/p>\n\n\n\n<p>Ich brauche <strong>Deutsch<\/strong>kenntnisse auf <strong>A2<\/strong>-Niveau (<strong><a href=\"https:\/\/digmit.at\/index.php\/ich-muss-fur-meinen-aufenthalt-eine-deutschprufung-machen\/#moduleins\">Modul 1 Integrationsvereinbarung<\/a><\/strong>).<\/p>\n\n\n\n<p><br><br>Wenn ich als <strong>EU-B\u00fcrger*in<\/strong> oder <strong>EWR-B\u00fcrger*in<\/strong> <strong>von Gewalt, Menschenhandel oder Frauenhandel betroffen<\/strong> bin und l\u00e4nger als 3 Monate in \u00d6sterreich bleiben will, kann ich eine <strong>Anmeldebescheinigung<\/strong> beantragen, wenn ich <strong>arbeite<\/strong> und <strong>versichert<\/strong> bin.<\/p>\n\n\n\n<p><br><br>Wenn ich als <strong>Frau*<\/strong> <strong>von Frauenhandel betroffen<\/strong> bin, kann ich zur <a href=\"https:\/\/lefoe.at\/ibf\/\"><strong>LEF\u00d6-IBF \u2013 Interventionsstelle f\u00fcr Betroffene von Frauenhandel<\/strong><\/a> gehen.<\/p>\n\n\n\n<p>Dort bekomme ich <br>&#8211;
